H1B extensions  beyond six years

Nonimmigrant H1B workers may not remain in H1B status longer than six years, unless they qualify for an exemption. Time spent outside the United States and unpaid time in the US does not count toward the six year limit, provided it can be documented. This time may be "recaptured" and added to the worker's final extension petition. .

Case study: H4 status

Jack entered the United States as an H1B. His wife Jill entered as an H4. Jack received his visa and status on the basis of the H1B petition that his employer filed on his behalf. Jill received her visa and status as a result of Jack's petition.

SKIL Act of 2010

Senator Cornyn's SKIL (Securing Knowledge, Innovation, and Leadership) bill (HR 5658) has been updated and re-introduced, this time in the House by Rep. John Shadegg. It was introduced on July 1, 2010. This proposal came very close to getting passed into law in December, 2005. It passed the Senate comfortably and was set to come up for a vote in the House, where it was also expected to pass easily. Unfortunately, Cong. Sensenbrenner threw a temper tantrum over an imagined slight and the bill never came up for a vote.

Getting Congressional help with your inquiry

As priority dates leap forward for India and China EB2, more and more people are going to be taking various steps to see to it that the CIS closes out their files and adjusts their status. In the end, many people are going to find that Congressional assistance is the most productive route to success.

The H1B Cap Count as of July 9, 2010
H1B quota usage remains low for the new quota. As of July 9th, less than one third of the entire quota has been used. Recent weeks have seen a distinct increase in demand, however, which may signal that the end of the quota is in sight.

Have YOU moved?

Now that we have completed our move, we are in the process of sending amended G-28 forms to the CIS to notify them of our current address. In the course of doing this, we have discovered that many of our clients have moved and not notified us. If you have moved, it is imperative that you give us your current contact information. If you haven't done so, please do so immediately.
