Rumor control: Substituted labor certifications

Lately, there has been a great deal of concern about "substituted" labor certification. Many rumors have been flying around the Internet and have caused a great deal of unnecessary worries. The purpose of this article is to review the law on this subject and provide people with information so that they are able to get on with their lives and not worry.

CIR Update (April 15, 2010)

There has been a flurry of news about CIR in the last two weeks. Last Saturday, the Senate Majority Leader, Harry Reid, announced that Congress would take up CIR very soon. In his announcement, he said "as soon as we return." That was widely understood as meaning this past Tuesday. Obviously that did not happen. Later, Senator Reid clarified his remarks to say that he means that CIR will be taken up in the next "work period" - meaning the session after Memorial Day.

The new EB backlog reports: What do they really show?
Last September, the USCIS released a report that purported to describe the content and extent of the adjustment of status backlog. In January, the Department of State's Visa Office (VO) released a report that showed the backlog of the National Visa Center. Finally, in February, VO began releasing monthly reports that show the known backlog of employment based applications, based on the reports from the USCIS and the NVC. Many people misunderstand what these reports actually show and, as a result, misinterpret the data.

Fiscal Year 2011 H1B Quota Filings
The H1B quota for fiscal year 2011 opens as of October 1, 2010. Since it is possible to file an H1B petition up to six months before the requested employment authorization begins, the USCIS began accepting petitions for the new fiscal year as of April 1, 2010.
