| New precedent decision involving AC21 I-140 portability. | |||
|
On October 20, 2010, the USCIS Administrative Appeals Office (AAO) published a new precedent decision, Matter of Al-Wazzan (ID 3699). This decision is significant for at least two reasons that are relevant to issues of AC21 I-140 portability. First, it makes it clear that USCIS policy memos are not "law" and may not be relied upon. Second, it makes it clear that unless an I-140 has been approved, it is not possible to port successfully to another employer. |

Bob has an application for adjustment of status pending, based on his previously approved EB3 petition. Unfortunately, the EB3 cutoff date retrogressed and it is unlikely that it will become "current" again for him for quite some time. For this reason, he elected to upgrade from EB3 to EB2. |

| Clients of our office: please update your information. | |||
|
As those of you who are our clients know, we recently upgraded to a newer and much more advanced client management system. In the course of migrating data from our old system to the new system, some information was lost. More to the point, we discovered that much of the information in our old system was out of date. That is, client addresses, expiration dates, and other important information were no longer current. |
