New USCIS fee increase becomes effective November 23rd.

The USCIS fee increase will take effect on November 23rd. All petitions and applications postmarked or received after that date will be subject to the new fees. The CIS provided the following questions and answers in connection with the fee increase:

The new I-129 form will  become effective on November 23rd.

Earlier this year, the USCIS published a proposed new I-129 form in the Federal Register. On November 23rd, the final version of the new I-129 form will take effect. The new form will become mandatory as of December 21st.

Case Study: AC21 I-140 porting before petition approval

Jack's company filed a PERM for him in early 2007. When all priority dates  became current in July of that year, they filed an I-140 on his behalf while he filed a concurrent I-485. In 2009, Jack received a better offer from another company and changed employers. At the time, he believed that he had a legal right to do this under the I-140 portability provisions of the AC21 legislation. He was wrong.

Export control is about to become a major issue in H1B petitions. 

Export control is about to become a major issue in H1B petitions. The CIS has just announced that they are promulgating a new version of form I-129, effective November 23rd. This new form, at Part 7, now requests information concerning export control issues that may be associated with the H1B beneficiary's employment.
