| How does Section 245(k) work? |
|
Generally, with the exception of “immediate relatives,” the law provides that anyone who violates their nonimmigrant status may not adjust status to lawful permanent residency. Section 245(k) of the Immigration and Nationality Act provides relief from ineligibility to adjust status based on violations of nonimmigrant status. The specific statutory language provides: |

| CIS Lockboxes (or where applications go to die) |
|
The CIS has gone over to the use of “lockboxes” for new filings. While not a complete disaster, for the most part the lockbox system has caused more problems than it has solved. The purpose of the lockbox system is to streamline the process and guard against the internal theft of filing fees that has been all too common at the service centers. The lockbox personnel are supposed to receive filings, perform a check to determine if the filing is complete, strip off the checks, put the documents into a file folder, enter the new filing into the system, and then forward the physical file to the appropriate service center for processing. |

| Immigration Information Discussion Forum |
|
As those of you who participate in the ImmInfo Discussion Forum know, the site has been down more than it has been up for the last three weeks. Initially, we had a problem with the provider we were using. They came under attack and our site suffered. We moved to a second provider and that turned out to be an unmitigated disaster. | USCIS Memo on the "admin fix" idea |
|
Recently, an internal CIS memorandum surfaced on an anti-immigration web site. From the context of the memo, it is clear that this was intended for consideration of various administrative options. This was likely the source of the recent allegation made by several Republican senators that the administration was considering an "administrative amnesty." |
